Taking into account a high public interest, we would like to clarify the statement made by the President today:
A few days ago the President informed the Prime Minister about the fact of searching of his family member by the law enforcers. The Prime Minister instructed the Minister of the Internal Affairs to clarify the incident. Accordingly, there is the assumption that the President presumably referred to the following fact:
The MIA Central Criminal Police has launched the investigation under the 2nd and 3rd parts of the article 236 of the Criminal Code of Georgia (illegal purchase, storage, carrying of firearm). Based on operational information, the law enforcers searched three individuals in Tbilisi on June 28, 2016: Tornike K – date of birth: 1989, previously convicted several times; Mikheil T - date of birth: 1988, previously convicted several times Mindia G – date of birth: 1989. One of the above mentioned individual was the person being in unregistered marriage with the daughter of the President’s spouse. Personal search of the mentioned individuals revealed that Mikheil T. and Mindia G. did not have any illegal object while a cold arm was seized during the personal search from Tornike K. The investigation activities were recognized by the court as legal.
On the basis of the same operational information, the vehicle and the apartment of Mindia G was searched; no illegal item was found as a result. Accordingly, the issue of criminal responsibility against the above mentioned individual was not set within the frames of the investigation.
It should be emphasized that the operative-investigation measures were conducted in accordance with the legislation of Georgia, in full observation of the rights of the participants; the mentioned measures were aimed at reveal and prevention of a crime. All are equal before the law. Thus, for us the interpretation of police measures in any other form is unacceptable.
