Deputy Minister of Internal Affairs, Aleksandre Darakhvelidze, presented draft laws developed by the Ministry of Internal Affairs "On Amendments to the Code of Administrative Offenses" and "On Amendments to the Law of Georgia on Road Traffic" at the plenary session of the Parliament.
In the third reading, the Parliament adopted the mentioned draft laws, considering the road traffic safety issues, with 77 votes.
According to changes, the penalties for speeding will be increased. Exceeding the established speed limit by a vehicle driver at a speed of more than 40 km/h will result in a fine of 300 GEL instead of 150 GEL.
Administrative liability for intentional sliding of the vehicle and/or making circular rotation with sliding (drift). A fine in the amount of 300 GEL and a 30-point reduction of the points on the driver's license are defined as a sanction, and if it results in damage, it will lead to a fine of 500 GEL and a reduction of the points on the driver's license by 35 points. "Drift" shall not be punishable during the event when the maneuver is performed while participating in a sports event conducted in accordance with the rules established by Georgian legislation.
According to the legislative changes, the penalty is differentiated according to the percentage of darkening of vehicle windows. If the darkening of the windows exceeds the established norms by no more than 10%, the sanction will be 100 GEL and the points on the driver's license will be reduced by 5 points. If the darkening of windows exceeds the established norms by more than 10% - a fine of 500 GEL and a reduction of 10 points on the driver's license will be applied. In addition, the sanction for installing a special flashing signal on a vehicle in violation of the rule defined by the Minister of Internal Affairs and/or using the color specified for operational or special service vehicles will be established in the amount of 2,000 GEL instead of 200 GEL.
Legal responsibility is established for driving a vehicle, the level of noise of which generated during its operation exceeds the established norms. As a sanction, a fine of 100 GEL and a reduction of 10 points on the driver's license will be applied. Permissible noise norms are determined by the government decree, and the procedure for checking the noise level is defined by the order of the Minister of Internal Affairs.
Driving on the road with an oversized (oversized) and/or heavy weight vehicle without an agreement with the relevant authority and/or the corresponding protection-exit defined by the law will result in a fine of 1,000 GEL instead of 100 GEL. If the mentioned action results in damage, it will result in a fine of 2,000 GEL.
Driving a vehicle without a pair of state license plates, with a state license plate of another vehicle or with a disguised or otherwise altered state license plate will be fined with 2,000 GEL.
The procedure for handing over a fine receipt issued to a foreigner or stateless person has been regulated. The fine receipt issued to a foreigner or a stateless person will be published on the official website of the Ministry of Internal Affairs, and it will be considered delivered to the person on the 30th day after publication. A fine receipt may be handed over to a foreigner or stateless person when crossing the state border of Georgia. In case of non-payment of the fine or fine, the foreigner may be refused a Georgian visa or re-entry to Georgia.
Similar to video fines, the procedure for handing over the resolution adopted by the Ministry of Internal Affairs in the case of an administrative offense will be defined, which will reduce the cases of failure to hand over the resolution adopted by the Ministry of Internal Affairs.
The law will come into effect on the 15th day after publication, the noise regulations will come into effect on January 1, 2024.
