The draft law of Georgia "On the DNA database" prepared under the authorship of the Ministry of Internal Affairs and the subsequent legislative amendments were supported by the Parliament of Georgia in the first reading.
The package of legislative changes envisions the creation of DNA database in Levan Samkharauli National Bureau of Forensic Expertise in order to promote crime prevention, crime detection and investigation, as well as the identification of missing persons.
According to the draft law, it will be mandatory to register the genetic profile of accused person and convicts in the DNA database. In addition, the DNA database reflects the genetic profiles determined from a natural person, corpse, scene of an accident or other material object within the framework of the investigation of a criminal case.
In addition, it will be allowed to register the genetic profile voluntarily submitted by any person in the DNA database.
According to the mentioned legislative change, the employees of Levan Samkharauli National Bureau of Forensic Examination, the state sub-departmental institution included in the system of the Ministry of Internal Affairs and the Ministry of Justice - Special Penitentiary Service will have the authorization to take biological samples.
The presented legislative change defines the procedure for storage and destruction of biological sample and genetic profile. In particular, the biological sample will be destroyed as soon as the genetic profile is created. As for the storage period of the genetic profile, it will be determined according to the categories of crimes committed by the person subject to the mandatory profiling of the biological sample and his/her age.
