As a result of jointly held investigative-operative activities State Security Service of the Ministry of Internal Affairs and Main Prosecutor’s Office established the following:
In August of 2008 Roman Shamatava- Head of Abkhazia Main Division of MIA Constitutional Security Department ordered to the employees of MIA Special Tasks Department to illegally restrict freedom of Paata Kardava - employee of Intelligence Department of the Ministry of Defense and to transport him to Batumi.
In accordance with the received instructions on August 27, 2008 members of the criminal group illegally restricted freedom of Paata Kargada in Zugdidi, near to the post office and took him to the direction of Poti.
Near to the Tsaishi village, Zugdidi district, members of the criminal group took handcuffed and blindfolded Paata Kardava to Shekvetili settlement, where he was handed over to Roman Shamatava and his accomplices, while Mercedes made vehicle owned by Kardava was abandoned in vicinities of Khurcha village in order to mislead the investigation.
Roman Shamatava and his accomplices took Kardava to Batumi port, where he was accused of co-operation with Abkhazian separatists and physically assaulted by Shamatava. During the battery Paata Shamatava flatly denied accusations.
Under the order of Roman Shamatava, his group and Shamatava himself was awaited by the boat at Batumi port owned by the Ajara division of Constitutional Security Department, which was operated by the employee of the mentioned Department. Handcuffed and blindfolded Kardava was taken on board. Shamatava fastened the rope with weight on Kardava’s leg and sailed to the deep sea, 10 km away from the shore, where Paata Kardava was shot in head with a single bullet by Shamatava and thrown in the sea water.
For the committed crime Roman Shamatava was accused of illegal restriction of freedodm and premeditated murder under the article 143 IV part, sub-paragraph A ad article 109 II paart, sub-paragraph B of the Criminal Code.
Investigation is conducted by the employees of Investigation Division of State Security Service of the Ministry of Internal Affairs.
