The officers of Anti-corruption Agency of MIA as a result of operative-searching and investigative activities exposed Levan Tchania- interim representative of the head of Tsalenjikha local governance for assistance in swindling by misusing his official authority as well as resident of Tsalenjikha Nodar J. for illegal cutting of timber, swindling and encouragement of swindle.
Investigation established that on June 13, 2014 Levan Tchania encouraged Nodar J. and issued fake certificate confirming the ownership of 0,33 acres of land area on the name of Nodar J. On the basis of the fake certificate Nodar J. managed to register 3216 cubic meters of land area on his and family members names at public registry, out of which 2127cubic meters of land (18 887,76 GEL worth) was owned by the state and illegally misappropriated by Nodar J.
Despite the fact that land area located on Vekua Street N25 Tsalenjikha did not actually belong to Nodar J. he used to cut timber illegally from May to July of 2014 and caused 10 860 GEL fiscal damage to the state as a result. In order to make their actions look legal, Levan Tchania issued fake certificate on June 9 and July 1 of 2014 as if timber was cut in the land area owned by Nodar J. The mentioned action was encouraged by Nodar J. and committed by Tchania.
For the committed crime Levan Tchania and Nodar J. became subjects of legal persecution on January 13, 2015.
Investigation is in progress on the fact of assistance in swindling by misusing official authority, swindling, encouragement to commit swindling and illegal cutting of tree and bush plants, articles 180, III part, sub-paragraph A and B, article 341and 303 I part. The committed crime envisages from 6 to 9 years of imprisonment. Investigation is conducted by Anti-corruption Agency of MIA.
