After the legislative changes that came into force on September 1, 2020, the Ministry of Internal Affairs launched electronic monitoring for the first time.
Marneuli Police Division under Kvemo Kartli Police Department of the Ministry of Internal Affairs has launched an investigation on the facts of domestic violence and threat under the article 126 1, Part 1, Article 111-151, Part 2, Subparagraph "d" of the Criminal Code of Georgia.
The investigation established that the accused individual, born in 1985, physically assaulted his spouse - RA, (DoB 1983) and threatened with liquidation.
After assessing the risks of recurrence of violence from the side of the abuser and on the basis of the victim's consent, it was decided to establish electronic surveillance to the abuser, in parallel with issuing a restraining order.
Investigation is in progress on the facts of domestic violence and threat under the article 126, Article 126 1, Part 1, Article 111-151, Part 2, Sub-paragraph "d" of the Criminal Code of Georgia. The committed crime envisages a maximum of three years of imprisonment.
It is notable that the draft law on the introduction of electronic surveillance against abusers was initiated by the Ministry of Internal Affairs. Aim of the initiative was to increase and improve the level of victim’s safety.
Virtual monitoring of the abuser through electronic bracelet is provided by the Public Safety Management Center "112" under the Ministry of Internal Affairs. Fulfillment of obligations imposed to abuser shall be mandatory. Avoidance of electronic surveillance by the abuser entails liability envisaged by the Criminal Code.
