On September 1, 014 Law "On Legal Status of Foreigners and Stateless Persons" was enacted based on which Ministry of Internal Affairs has been determined as responsible agency for the fight against illegal migration. In particular Migration Department of MIA is responsible for the identification of illegal migrants in the country without any legal basis, the arrest and expulsion.
On the basis of the mentioned law period till July 1 of the current year has been determined as the grace period during which foreign nationals in Georgia without legal grounds had an opportunity to gain legal status without leaving the state.
During the grace period Migration Department in collaboration with the relevant agencies informed foreign nationals on how to settle the issue with documents without leaving the country.
Beginning from July 1, 2015 after full implementation of the law Migration Department as a result of the special activities exposed 3 foreign citizens: citizen of Uzbekistan E.T. (DoB 16.12.1971), citizen of Islamic State of Iran H.D.K. (DoB 26.02.1966) and citizen of the federal Republic of Nigeria O.J.J. (DoB 02.10.1988) without had no legal status in Georgia.
Based on the petition of the Migration Department, Batumi civil Court Administrative Board decided to expel Uzbek citizen E. T. from Georgia back to Uzbekistan. E.T. was given 20 days to leave the country voluntarily. E.T. did not use the mentioned right which is why Migration Department of the Ministry of Internal Affairs conducted the forced expulsion procedure to Uzbekistan. The mentioned person is prohibited from crossing Georgian state border for the term of five years.
It was also established that the citizen of Islamic State of Iran H.D.K was in Georgia without legal grounds and convicted in Georgia as well. Mtskheta Regioal Court decided to place the mentioned person at migrants’ accommodation center for three months. On the basis of the petition of the Migration Department Tbilisi civil court administrative board decided to expel H.D.K. to Islamic State of Iran. H.D.K. was given 10 days to leave the country voluntarily. The mentioned person is prohibited from crossing Georgian state border for the term of five years.
Regarding the citizen of the Federal Republic of Nigeria O.J.J. Tbilisi civil court decided to place the mentioned person at migrants’ accommodation center for three months, while Migration Department made a decision to expel O.J.J. to the Federal Republic of Nigeria. H.D.K. was given 10 days to leave the country voluntarily.
