We would like to respond to the accusations against the employees of the Ministry of Internal Affairs made in one of the posts on Facebook page of one of the leaders of the “Coalition for Change”- Elene Khoshtaria.
We would like to clarify that on March 28 of the current year, the manifestation, in the vicinity of the Parliament, Elene Khoshtaria was detained in accordance with Articles 166 and 173 of the Code of Administrative Offenses for disobeying the lawful request of a police officer and for petty hooliganism.
After the detention, appropriate legal measures were taken against her. Initially, she was transferred to the police administrative building, and then to a temporary detention center.
Before being placed in the isolation ward, the procedures established by law were implemented for the detained person, regulated by the Order No. 423 of the Minister of Internal Affairs of Georgia of August 2, 2016.
While undergoing procedures, Elene Khoshtaria violated the internal regulations of the isolation ward, namely, she refused to fully undergo the procedures prescribed by the law and behaved aggressively. Despite repeated calls from the staff and legal clarifications, she still refused to be examined. Based on security norms, the necessary procedures were carried out for the detained person before being placed in the temporary placement ward in full compliance with the acting legislation.
We would like to clarify here that during the examination, the detainee was found to be carrying an allegedly illegal substance, for which an appropriate examination has been ordered.
The procedures for placing the detainee in the isolation ward were recorded on the isolation ward’s video surveillance cameras. In case of interest, in accordance with the procedure established by law and with the consent of the detained person, the relevant authorities and the human rights defender have the opportunity to review the existing video footage.
In addition, after being placed in a temporary detention center, Elene Khoshtaria refused to meet with a representative of the Public Defender's Office.
