As a result of jointly held investigative-operative activities State Security Service of the Ministry of Internal Affairs and Main Prosecutor’s Office established the following:
In August of 2008 high-rank official of MIA Constitutional Security Department received order from the leadership of the mentioned Department to take Ranger Davit Tsindeliani (the resident of Tchiberi village, Svaneti) to Tbilisi with the purpose of his questioning. According to the information of the Constitutional Security Department, Tsindeliani was linked to Abkhaz separatists.
Constitutional Security Department was informed that on August 16, Forestry Department appointed Meeting of Samegrelo-Zemo Svaneti employees, where Davit Tsindeliani was supposed to appear.
Approximately at 17:00 of August 16, 2008 employees of Constitutional Security Department who operated Mercedes and Opel made vehicles, made an ambush to the vehicle on crossing of Ninoshviil and Grishashvili Streets located in Kutaisi where Tsindeliani and his father were supposed to be. Davt Tsindeliani was taken to Kutaisi-Baghdati route and after some period employees of Constitutional Security Department changed vehicle and went to Baghdati-Sairme bypass road the direction of Tbilisi. Lately, after receiving direction through the phone Davit Tsisndeliani was taken to the direction of Batumi instead of Tbilisi and was handed over to Roman Shamatava Head of Abkhazia Division of Constitutional Security Department. Roman Shamatava and his co-workers took Davit Tsindeliai to the Batumi Port and accused him in co-operation with Abkhazian separatists. The accusations were denied from the side of Tsindeliani.
Under the order of Roman Shamatava, his group and Shamatava himself was awaited by the boat at Batumi port owned by the Ajara division of Constitutional Security Department, which was operated by the employee of the mentioned Department. Handcuffed and blindfolded Tsindeliani was taken on board. Shamatava ordered his employee to accompany him and sailed deep in the sea, 4 km away from the shore, where Tsindeliani was shot in head with a single bullet by Shamatava, who fastened the anchor to the victim’s head and threw the body in the water.
For the committed crime Roman Shamatava was accused of illegal restriction of freedom and premeditated murder in aggravating circumstances under the article 143 II part, sub-paragraph C and article 109 II part, sub-paragraph B of the Criminal Code. Investigation is conducted by the employees of Investigation Division of State Security Service of the Ministry of Internal Affairs.
