Police officers are deployed at the adjacent territory of Tbilisi City Assembly in compliance with the request of the Chairperson of Tbilisi City Assembly, in order to prevent the violation of public safety in the building of the Assembly.
Pursuant to paragraph 1 of Article 16 of the Law of Georgia on Police, the main function of the police is to ensure protection of public safety and security. To this end, the relevant powers are conferred on the police, in particular, pursuant to paragraph 1 of Article 25 of the Law of Georgia on Police, “police officer is entitled to request from a person to leave a certain place for a specified time or to prohibit him/her entering the particular territory, if it is necessary for the prevention of threat”. Taking into consideration, that statement of the Chairperson of Tbilisi City Assembly, as well as information obtained from open sources provided sufficient basis for assumption that letting activists of various political parties into the building may give rise to physical and verbal confrontation and may create threat to citizens, the police took the decision to use power conferred on it pursuant to Article 25 of the Law of Georgia on Police.
As regards the issue of the restriction of admittance of the members of the Parliament of Georgia to the building of the Assembly, it should be noted that according to the subparagraph “d” of the paragraph 3 of Article 16 of the Rules of Procedure of the Parliament of Georgia: “member of the Parliament has a right to enter freely all state organizations except for the cases determined by the law”. Accordingly, the law, which gives the Member of the Parliament such right, itself establishes limitations in favor of conditions determined by other legislative instruments.
We emphasize that the police acts within the framework of the law, in compliance with the principle of political neutrality.
We call upon every citizen, representatives of political parties, to refrain from attacking the police or initiating provocation and to obey the legal requests of the police.
