Administrative offences and misconduct

1.	In my opinion, the fine drawn up for the violation of road laws is groundless. How should I appeal the decision of the Police and prove my guiltlessness?
	Answer: The fine issued on your name should be appealed in the Patrol Police Department of the Ministry of Internal Affairs. According to the Article 272 of the Code of Administrative Offences of Georgia decision of an agency (official) as well as decision on charging administrative penalty as a fine taken on the scene of the administrative offence might be appealed at the superior agency (higher official) or district (city) court the decision of which should be final.
2.	I have can accident. Should I call for the Police or I can deal with a driver?
	Answer: According to the legislation of Georgia in case of car accident the citizen should call for the Patrol Police.
3.	In what amount is fined a person for speed exceed?
	Answer: According to the Article 125 of the Code of Administrative Offences of Georgia speed exceed with more than 15 km/h is fined in the amount of 100 GEL.
4.	Deadline prescribed for the fine for administrative offences has expired, will I be charged with additional fine?
	Answer: Upon expiration of the period assigned for voluntary execution of the fine you will be charged to pay the penalty according to Georgian legislation. Failure to pay this penalty will result in deprivation of driving right. Deprivation of driving right will not relieve the individual form his/her obligation to pay the fine and penalty.
5.	The vehicles parked on the pavement prevent the civilians in their movement. Whom should I apply to?
	Answer: You have to apply to the Patrol Police of the MIA or the "City Park" company.
6.	In case of fining by a patrol officer can I pay the fine immediately, on place by my credit card?
	Answer: No, you can not. You have to pay the fine at any bank (bank institution, ATM or by INTERNET with your credit card) or in the Administrative Offences Registration Unit of the Department of Patrol Police in 8, Gulua str. The fine will be reflected in the centralized database of the Ministry and such reflection needs certain time with the technical point of view. Upon the mentioned procedure payment of fine will be available.
7.	I was drunk and with the purpose of safety I asked another individual without driving license to drive my vehicle; is such behavior subject to fine?
	Answer: Handing over a motor vehicle to a person who does not have a driving license will be punished under the II part of the par 121, the Administrative Offences Code of Georgia; the punishment envisaged fining of a vehicle owner in amount of 200 GEL.
8.	Can a police officer issue only a warning in case of violation of traffic rules?
	Answer: Yes, he can. As per Article 22 of the Administrative Offences Code of Georgia in case of minor administrative offence the competent organ (official) can relieve the offender from an administrative liability and give a verbal warning only.
9.	I have lost the fine paper. How can I learn the payment deadline?
	Answer: You have to apply to the Administrative Violations Registration Unit of the Department of Patrol Police in 8, Gulua str. or call: 241-17-92; 241-17-94; 241-18-03 and you will be provided with the detailed information regarding the mentioned issue.
